AGREEMENT                         AGR.No:- ......................
PROJECT NAME: BHUPATI VIHAR

This agreement is made on the date  of -----------------between  M/s RAGHUPATEE Estate & Holding Pvt. Ltd., being represented by its Managing Partner Mr. Prabhat Kumar Nanda, S / o – Late Purna Chandra nanda, aged about 41 years, office at Plot No : 03, Shakti Nagar, Link Road, Cuttack, Orissa. Hereinafter to be referred as developers, executants of the first Part.

AND
…………………………., aged about ……..  years, S / o : ---------------, resident of : -------------r, Po :- ------------------------Dist :- ---------------------Orissa. Hereinafter to be referred as the intending Purchaser of the Second Part.

Whereas by the strength of this agreement will sell some land under Plotted Scheme Primarily in the name and style of “BHUPATI VIHAR”  at Mouza :- Anantapur/Bhubaneswar

M / s RAGHUPATEE Estate & Holding Pvt. Ltd. shall provide roads space for drainage Facilities, necessary leveling, for open space, common utility area, Commercial Complex, educational institution & health home, Plantation , etc.
AND that the firm as the developer of the site had made Publication, advertisement, hoarding, issued brochures, leaflet etc, inviting the public to Purchase polts at “Bhupati Vihar” under a duly regulated Scheme of/ Out-registration--------------------.
Now that the  Sale Price of the Plot measuring-------------Sq.ft. Sub. Plot No :-……………& others. Total Cost :- ……………………….(Rupees                                      )only.
The firm as a developer of the Plot shall make precise demarcation of the plots and basis infrastructures & developments as stated above.
That the condition between the firm and the intending buyer shall stand as follows.

  1. (a)  Rs. ……………….(Rupees……………………….) only as an advance Payment at the time of execution of the agreement deed in the manner of Cheque No :- (…………) in favor of M/s RAGHUPATEE Estate & Holding Pvt. Ltd.

(b) Cheques are subject to realization i.e., on the occasion of the cheque (Pertaining to down payment) being dishonored the said agreement will cease to have force and will automatically be declared null and void.
(c)He shall pay the rest amount within -------------------
(d)That the Purchaser shall pay the installment amount on or before seventh of every month and must obtain a receipt from the developer.
AND all the terms and conditions contained on the Membership
Application Form No :- ------------i.e. from clauses --------------are all applicable. -----------------------------------.

This agreement is made on the date  of -----------between  M/s RAGHUPATEE Estate & Holding Pvt. Ltd., being represented by its Managing Partner Mr. Prabhat Kumar Nanda, S / o – Late Purna Chandra nanda, aged about 41  years, office at Plot No : 03, Shakti Nagar, Link Road, Cuttack, Orissa. Hereinafter to be referred as developers, executants of the first Part.

AND
…………………………., aged about ……..  years, S / o, w/o,------------, resident of -------, Po :-----------, Dist :- --------------Orissa. Hereinafter to be referred as the  Purchaser of the Second Part.

Whereas by the strength of this agreement will sell some land under Plotted Scheme Primarily in the name and style of “JYOSTNA VIHAR”  at Mouza  Bhanpur/ pratapnagari/j aripada/urali, cuttack.

M / s RAGHUPATEE Estate & Holding Pvt. Ltd. shall provide roads space for drainage Facilities, necessary leveling, for open space, common utility area, Commercial Complex, educational institution & health home, Plantation , etc.
AND that the firm as the developer of the site had made Publication, advertisement, hoarding, issued brochures, leaflet etc, inviting the public to Purchase polts at “Jyostna vihar” under a duly regulated Scheme of/ Out-registration ------months.
Now that the  Sale Price of the Plot measuring -----------(Approx) Sq.ft. Sub. Plot No :-……………& others. Total Cost :- ……………………….(Rupees                                      )only.
The firm as a developer of the Plot shall make precise demarcation of the plots and basis infrastructures & developments as stated above.
That the condition between the firm and the intending buyer shall stand as follows.

  1. (a)  Rs. ……………….(Rupees……………………….) only as an advance Payment at the time of execution of the agreement deed in the manner of Cash in favor of
    M/s RAGHUPATEE Estate & Holding Pvt. Ltd.

(b) Cheques are subject to realization i.e., on the cheque (Pertaining to down payment) being dishonored the said agreement will cease to have force and will automatically be declared null and void.
(c)He shall pay the rest amount within-------------, at equal Monthly Installment of Rs:- ………………
(d)That the Purchaser shall pay the installment amount on or before seventh of every month and must obtain a receipt from the developer.
AND all the terms and conditions contained on the Membership
Application Form No :- ---------------i.e. from clauses 2 to 25 are all applicable. --------------------------.

Conformation of Booking at “PRISTINE PARK
                         
It is hereby confirm on the date of ………….., 2011 between M/s RAGHUPATEE Estate & Holding Pvt. Ltd., being represented by its Managing Director Mr. Prabhat Kumar Nanda, S/o: Late Purna Chandra Nanda, aged about 41years, office at Plot No. 03, Shakti Nagar, Link Road, Cuttack, Odisha.  Hereinafter to be referred as developers, executants of the First Part.

                                             AND

SRI/SMT. …………………….., aged about ……years, S/o,W/o: ……………., , by Profession , resident of at: …………………., P.o: ……………, P.s: ………….., Dist: ……………, Odisha. Hereinafter to be referred as the intending purchaser of the Second Part.
            
Whereas by the strength of this conformation the firm will seal some flats/house(s) under housing scheme primarily in the name and style of   “PRISTINE PARK’’ at Mouza: Sainda, Cuttack.

M/s RAGHUPATEE Estate & Holding Pvt. Ltd. shall provide open space, common utility area, community hall, health home, drivers & servants rest shade, other related amenities & plantations etc.

AND that the firm as the developer of the site had made publication, advertisement, hoarding, issued brochures, leaflet etc, inviting the public to purchase flat/home at “PRISTINE PARK” under a duly regulated scheme of out-right registration/ installment scheme.

          Now that the Sale Price of the flat measuring super built-up area ……….(Approx) sq. feet. Flat No. ……….., on ………. floor is Rs. …………/- (Rupees ………………………………………….) only. The firm as a developer of the township shall make construction of the flat and basic infrastructures & developments as stated above/ as mentioned in the brochures.
          That the condition between the firm and the intending buyer shall stand as follows.
1. Rs. …………………/- (Rupees ……………………….) only as an advance payment at the time of the conformation deed in favor of M/s RAGHUPATEE Estate & Holding Pvt. Ltd.
2. Cheques are subject to realization i.e., on the occasion of the cheque (pertaining to down payment) being dishonored the said conformation will cease to have force and will automatically be declared null and void.
3. Conformation of booking stands on payment 15% of total amount (Conform of Sqfeet. Rate, Super built-up area).

4. Allotment should stand on payment of 35% of total amount (Conform of Sqfeet. Rate, Super built-up area, Floor, Unit No.).
5. Allotment should stand first-cum first serve basis.
6. The purchaser shall pay the rest amount as per brochures schedule.
7. That   the purchaser shall   pay the installment amount on or before seventh day of every month and must obtain a receipt from the developer.
